“BOWL FOR USD$100K COMPETITION”

1.     Only persons eighteen (18) or older, on the date of the relevant draw, can claim prizes. Proof of age of the winner is required before redeeming a prize.

2.     Digicel employees, dealer principals or employees of any of our affiliated companies, advertising, promotion and public relations agencies, dealers, distributors, or anyone else connected with this promotion and their immediate family members and household members are not eligible for entry. For these purposes immediate family members are spouses, parents, siblings and children.

3.     Winners will be required to sign a Declaration of Compliance with these Terms and Conditions and a Release Form releasing each of our legal entities, their respective affiliates, parents, subsidiaries, directors, officers, employees, agents, dealers, dealer principles, distributors and advertising, promotion and public relations agencies (collectively, the "Releases"), from any and all claims or liability of any kind arising from or in connection with this contest or a prize, including, without limitation, claims or liability in connection with the acceptance, use or misuse of the prize as awarded. Declaration and Release documents must be completed and returned prior to collection of the prize or the prize may be forfeited.

4.     The Competition is open to all Digicel Subscribers who are permanent residents of the following countries (‘Subscribers’):

5.     Subscribers from all countries above, excepting Jamaica, enter the Competition by texting “More than a Match” to the number assigned to the country in which they are resident. Please see the list of phone numbers and text charges for each country on www.digicelcricket.com .

6.     Subscribers from Jamaica are required to text a reply to the question “Why is West Indies Cricket more than a match?”. For the number to text and the charge please see the list on www.digicelcricket.com .

7.     To be eligible to win, Subscribers’ accounts must be active and in good standing at the time of the prize draw.  If calls to a Subscriber number are barred, where service to a Subscriber number has expired or has been deactivated or where a warning has been issued to a Subscriber in relation to service to their Subscriber number the Subscriber will not be eligible to win.

8.     The Competition entry period is from 04 February 2009 to 16 March 2009

9.     On 16 March 2009 two (2) finalists among all eligible entries will be selected at random from each of the countries listed above. If a Subscriber chosen as a finalist cannot be contacted via their Subscriber number within two hours then another finalist will be chosen. This process will be repeated until two (2) finalists are chosen from each country.

10.  The Subscriber entering the competition must not be a past or present professional cricket player, or club cricket player, They must not have represented their country or international region cricket team or have played First Class Cricket, where First Class Cricket refers to the class of cricket matches played over three (3) or more days

11.  Digicel personnel will contact these finalists to obtain their name, photograph and one sentence stating why they think they are the most passionate West Indies Cricket Fan (‘the caption’). Any Subscribers entering this Competition understand and acknowledge that their name and image will be posted on the website www.digicelcricket.com and the Subscriber accordingly gives Digicel permission to use their name and image in any promotional material.

12.  On 18 March 2009 the finalist’s names, photographs and captions will be posted on the website www.digicelcricket.com so that members of the public may vote for the finalist who they want to win the prize.

13.  Digicel will check if the finalists have complied with these terms. If the finalists fail to comply with these terms their position is forfeited and a new draw done for a new finalist.

14.  On 22 March 2009 Digicel will announce two (2) finalists with the most votes who are entitled to the prize. Digicel will contact the winners on the 22 March 2009. If a Subscriber chosen as a prize winner cannot be contacted via their Subscriber number within four hours then the finalist with the next highest votes will be chosen. This process will be repeated until two (2) prize winners are chosen.

15.  We accept no responsibility for loss, damage, or claims caused by, related to, or in anyway resulting from the prize, its exercise or acceptance. Winners agree that they will sign a Declaration of Compliance with these Terms and Conditions and a Release Form releasing each of our legal entities, their respective affiliates, parents, subsidiaries, directors, officers, employees, agents, dealers, dealer principles, distributors and advertising, promotion and public relations agencies (collectively, the "Releases"), from any and all claims or liability of any kind arising from or in connection with this contest or a prize, including, without limitation, claims or liability in connection with the acceptance, use or misuse of the prize as awarded. The Declaration and Release documents must be completed, notarized and returned prior to collection of the prize or the prize may be forfeited.

16.  Prize consists of (a) round-trip, economy-class air transportation, for use solely by the prize recipient and their guest to Barbados, (b) three (3)] nights’ hotel accommodations (in a single room to be shared by the prize recipient and their guest), and (c) tickets to the Kensington Oval Cricket grounds for one (1) day to see the West Indies vs England for the 5th One Day International, (d) spending money of  USD50 per diem per person per day.

17.  At the Kensington Oval Cricket ground the prize winners will each be given an opportunity to bowl twice at the stump The stump must be inserted into the ground as it would be during a test match. The only stump that will be in the ground for the attempts will be the middle stump A coin toss will decide which winner goes first. The first winner to bowl the stump out of the ground will be the winner of US$100,000.00. Both participants will have two attempts each unless the first participant bowls the stump completely out of the ground in which case the competition ends. If a participant bowling their first ball knocks the stump partially out of the ground the stump will remain in that position for their second and final attempt. The stump must be inserted fully into the ground for the second participant’s attempt. If neither winner bowls the stump out of the ground, both winners will be entitled to conciliatory prizes of a Blackberry Handset

18.  The participant must bowl legally i.e. a straight arm should be used overarm aligning with ICC regulations of a legitimate action. and the ball should be bowled at least the distance of an official pitch i.e. 20.12 metres

19.  Travel insurance is not included; where Departure Tax is not added to the price of the airline ticket this must be borne by the prize winner and his/guest.

20.  All costs and expenses not expressly included herein in connection with the prize (including, without limitation, transportation to and from airport of origin, food and beverages, and other incidental costs), and all applicable taxes, will be the sole responsibility of the actual prize recipient.

21.  Air transportation may require connecting flights. We reserve the right to require the travelers to fly on certain days of the week, and/or at certain times of the day or night, and/or on certain airline carriers.

22.  The Winners and their designated guest/travel companion must be able and available to travel together on the same itinerary and must be able and available to travel on those particular travel dates that we may specify. Hotel accommodations will be at a hotel selected by Digicel. The prize trip is subject to availability and confirmation of reservations.

23.  The Winner’s guest/travel companion must be 18 years of age or older, unless such guest/travel companion is a member of the Winner’s immediate family. The Winner and their guest/travel companion will be required to execute the Declaration & Release documents prior to the issuance of travel documents.

24.  Flight details are subject to space availability, and the airline carrier’s regulations and conditions apply. The prize trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. Certain additional restrictions and blackout dates may apply. Airline tickets are non-refundable, non-exchangeable, non-transferable, not redeemable for cash, and not valid for upgrades.

25.   Passport and visa requirements are the responsibility of the prize winner and their guest and they will need to confirm their ability to travel by the 27^th March 2009 If the prize winner does not by the 27^th March 2009 have a passport or any required visa the prize is forfeited and another finalist with the next highest number of votes will win the prize.

26.   The Prize Winner and their guest must satisfy themselves that they are fit to travel to take up the prize. If in doubt, medical advice must be taken and acted upon by prize winner and their guest.

27.  Digicel is not responsible under any circumstances for, and hereby irrevocably are released and held harmless by all entrants from and against, any and all lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or transmissions or technical failure, jumbled, scrambled or misdirected transmissions, incorrect or inaccurate entry information, howsoever caused, or other errors of any kind, whether human, mechanical or electronic.

28.   Subscribers found to be tampering with or abusing any aspect of this Competition, as solely determined by Digicel or the judges, will be disqualified from any further participation in this Competition and will become ineligible to receive any prize hereunder. Any attempt by any person deliberately to undermine the legitimate operation of the Competition may be in violation of criminal and civil law, and should such an attempt be made, Digicel hereby specifically reserve the right (among other causes of action and remedies) to seek and obtain damages from and against any such person to the fullest extent permitted by law. Digicel’s failure to enforce any provision of these official rules shall not constitute a waiver of that provision (or of any other provision hereunder).

29.  Digicel hereby specifically reserves the right to terminate, cancel, suspend and/or modify the Competition if any fraud, virus or other technical problem corrupts the administration, security, safety or proper play of the Competition, as determined by Digicel in its sole discretion. In such event, Digicel hereby specifically reserve the right (but not the obligation) to award some other prize hereunder (as determined by Digicel in its sole discretion) by means of a random drawing from among the eligible entries received up until the time of the impairment.

30.  All the prizes are personal and cannot be transferred by winners.

31.  A third party cannot claim a prize on behalf of a Winner even with a valid power of attorney.

32.  The Prize is as stated and cannot be exchanged or refunded.

33.  In the event of unforeseen circumstances Digicel reserves the right to offer an alternative prize without notice. No cash alternatives will be offered.

34.  This promotion is subject to all applicable laws. Taxes, including personal income tax, payable on any prizes are the Winner’s sole responsibility.

35.  Winner will be required to participate in any planned publicity in connection with this competition and by entering the promotion, the prize winner consents to the use of his/her name, likeness, image, photograph for any and all programming and/or publicity promotion or advertising purposes, commercial or otherwise, in all media and formats used by us or our agencies, without further compensation, throughout the entire world in perpetuity.

36.  These Terms and Conditions are subject to change at any time at the discretion of Digicel.

37.  Digicel’s decision is final and no correspondence will be entered into.

38.  To claim the prize the winner must present a valid and legal photographic identification and carry the phone with the wining subscriber number for verification that he/she is the person selected as the Winner.

39.  We accept no responsibility for any prize forfeited in any way.

40.  This promotion is subject to the laws of Jamaica.
